Last year Advatix, Inc. filed documents for registration of the VIDYA trademark, which is similar to NVIDIA. The latter did not like this, so a complaint was filed with the Dispute Resolution and Appeals Committee with a request to declare the registration invalid.
According to NVIDIA, Advatix, Inc. did not have a good faith intention to use the trademark for all goods and services. By this the company hints that the registration of such a trademark is deliberately conceived to be consonant with NVIDIA.
The graphics chip maker also noted that both names are similar not only visually, but also by ear. At the same time, the goods and services specified in the Advatix registration application are similar and / or related to NVIDIA goods and services.
As a result of such similarity, confusion or even deception of the consumer may arise, which NVIDIA does not want to allow. The company believes that it has the right to claim that the court invalidated the VIDYA registration.
